Weather

The weather can change quickly on the Hudson and oftentimes for the better. For this reason we wait until an hour before the charter for the Captain to make a determination on whether the boat sails or not.

We are constantly keeping an eye on the weather stations, and radar to track how it progresses.  If we need to cancel, we will call you at least an hour prior to your charter and reschedule your sail to a mutually agreeable date and time at no cost to you. Please note that it is the Captain who makes the call - should you opt to reschedule of your own accord, rescheduling fees will apply. We cannot refund booked charters on account of bad weather.

In short, we do not want to go sailing in bad weather as much as you do not, and we avoid doing so whenever possible. We are very reasonable when deciding whether to sail or to reschedule.  

If your charter coincides with severe weather conditions, we can reschedule your booking to any available date prior to October 31st of  the same year.


Charter Fee and Rescheduling Fee

The charter fee is deemed earned upon placing a hold for the desired date and time. By reserving a date and time with True Sailing, LLC, you agree to pay this fee.

True Sailing, LLC considers each request for rescheduling independently. Reschedules are subject to a fee. The amount of notice you give prior to your charter’s scheduled date determines the rescheduling fees are as follows:

14 days or more before scheduled date: 10%

13 to 4 days before scheduled date: 25%

24 to 72 hours before scheduled date: 50%


Additional Fees

For charters of four hours or more, a 15% crew gratuity will be added. The fee for early drop-off of goods, catering, and drinks is $95 per hour.


Cancellation

For safety reasons, True Sailing, LLC reserves the right to cancel your charter at any time due to severe weather conditions or a mechanical failure. In such an event, your sail will be rescheduled, at no additional charge, to a mutually available date prior to October 31st of the current calendar year. There are no refunds. Severe weather is determined solely by the Captain of the vessel.


Substance Abuse

The use of illegal substances is forbidden on board the vessel, as is underage use of alcohol and tobacco. Violating this rule will terminate the charter and there will be no refund.


Risks

By chartering a sail, you acknowledge that at marinas and aboard sailboats there is an inherent risk of personal injury or accident. You agree to release and hold harmless True Sailing, LLC, its owners, and employees from liability and responsibility for personal injury, property damage, or wrongful death, however caused, including but not limited to product defect or the negligence of the released parties.

You have discussed the risks with your invitees and they agree to release and hold harmless the owners and employees of True Sailing, LLC in the same manner as you have as stated in the above paragraph. Notwithstanding the aforesaid, you agree to hold harmless and indemnify the owners and employees of True Sailing LLC from any claims brought by your invitees.


Medical

If medical treatment is necessary for you or your invitees, you will be fully responsible for paying such expenses. Authority without limitation is granted to True Sailing LLC and it assigns in all medical matters to hospitalize and treat you and your invitees.


Disputes

All disputes shall be governed by Federal Maritime Law. In any action against True Sailing, LLC, its owners, or employees, which results in a decision, judgment, decree, order, stipulation, or settlement that substantially upholds the True Sailing, LLC position, the adversary party shall reimburse True Sailing LLC attorney’s fees, court costs, and expenses.
